Introduction

The Mental Capacity (Amendment) Act 2019 makes changes to the Mental Capacity Act (2005) introducing the Liberty Protection Safeguards (LPS) and making the Deprivation of Liberty Safeguards (DoLs) redundant.

The amendments will come into effect on 1st April 2022. This date has been pushed back several times because of the COVID-19 pandemic but it is looking increasingly likely it will be the actual implementation date.
